General Terms and Conditions
1. Scope
The following general terms and conditions apply to contracts between the guest/organizer (hereinafter referred to as the customer) and the Schlosshotel Münchhausen (hereinafter referred to as the Schlosshotel) for the rental of hotel rooms for accommodation, conferences, and events, as well as all other services provided by the Schlosshotel for the customer.
2. Conclusion of the Contract
By signing, the customer fully acknowledges the contractual components and services of the total volume contract.
Option dates are binding for both contractual partners. The Schlosshotel reserves the right to rent the reserved rooms and spaces to others after these dates have expired.
3. Room Reservations
Reservations made by the customer are binding for both contractual partners.
3.1. Right of Withdrawal
If no right of withdrawal has been agreed upon or has already expired, there is no legal right of withdrawal or termination. If the Schlosshotel does not agree to a contract cancellation, the Schlosshotel retains the right to the agreed compensation despite non-utilization of the service.
3.2. Cancellation or Reduction of Agreed Services
Cancellations or reductions must be made in writing. The cancellation date is determined by the receipt of the document at the premises.
In the event of a cancellation or reduction, the customer is obligated to pay the following portions of the contractually agreed total price for overnight stays with or without breakfast, if the Schlosshotel receives the written cancellation or reduction as follows:
3.2.1. Rooms (Reservations up to 5 rooms)

3.2.3. Rooms (Reservations from 6 rooms) - during trade fair periods

3.2.4. Deduction for Saved Expenses in Case of Alternative Rental
The Schlosshotel must credit the income from alternative rental of the rooms and the saved expenses.
If the Schlosshotel can provide the canceled or reduced service to third parties during the agreed period, the customer's compensation is reduced by the amount these third parties pay for the canceled service, but no more than the elimination of the entire compensation.
However, the Schlosshotel is free to provide exact proof that the aforementioned claim (the reduction of compensation) did not arise or only partially arose in the requested amount.
3.2.5. Deduction for Saved Expenses in Case of No Alternative Rental
If the rooms are not rented to others, the Schlosshotel can standardize a deduction for saved expenses.
3.3. Further Regulations for All Room Reservations
For reservations during trade fair periods and for groups of 6 or more people, the Schlosshotel reserves the right to request an advance payment of 100% of the services recorded in the contract to ensure and guarantee. The customer is obliged to transfer this advance payment to the bank account mentioned under point 4.
4. Events / Conferences (with and without rooms)
4.1. Contract Conclusion and Cancellation
For events and conferences, the Schlosshotel reserves the right to request an advance payment of 80% of the services recorded in the contract to ensure. For celebrations (private events and weddings), a deposit of 1,000 euros is required upon contract conclusion (this deposit is non-refundable in case of cancellation) and a further deposit of 100% of the estimated cost must be made no later than 30 days before the event.

In the event of a subsequent cancellation, the Schlosshotel reserves the right to charge the costs agreed in the order confirmation for lost revenue as follows:

If the rate for food or beverage sales has not yet been specifically set, the currently valid minimum cover price of 55 euros x number of people for food and 35 euros x number of people for drinks per occasion applies.
4.2. Further Regulations for All Events or Conferences
The Schlosshotel is free to prove that the aforementioned claim did not arise or only partially arose in the requested amount.
If the Schlosshotel can provide the canceled service to third parties during the agreed period, the customer's compensation is reduced by the amount these third parties pay for the canceled service, but no more than the elimination of the entire compensation.
Cancellations or reductions on the above-mentioned dates must be made in writing. The cancellation date is determined by the receipt of the document at the premises.
The reduction in the number of participants must be communicated in writing to the banquet department of the Schlosshotel at least 7 days before the start of the event, otherwise, the originally ordered number of covers will be charged.
The maximum reduction in the contractually specified number of participants within the cancellation periods mentioned in point 4 is 10%.
Price changes after contract conclusion due to changed market situations are not excluded and lead to price adjustments.
If music is used during the event, the organizer must register the event with GEMA if necessary. The Schlosshotel is indemnified by the organizer for all claims arising from the unauthorized use of GEMA's rights or those of third parties.
If the booked event/conference room is rearranged 48 hours or less before the start of the event/conference at the request of the contractual partner, the Schlosshotel charges a flat rate of 250 euros.
In case of severe contamination of the premises or the park area adjacent to the Schlosshotel by the event participants, the necessary cleaning costs will be charged separately to the contractual partner. A minimum amount of 350 euros is estimated.
Agreements/contracts are only concluded through legally binding signatures by the customer and the Schlosshotel. The Schlosshotel specifies an option date in the contract until which it is bound to the contract offer. If the contract signed by the customer is not received by the Schlosshotel by this date, the offer is void.
5. Other Information
As far as the Schlosshotel procures or has procured technical and other services from third parties for the customer, it acts in the name and on the account of the customer. The customer is liable for the careful handling and proper return of these facilities and indemnifies the Schlosshotel from all claims of third parties arising from the provision of these facilities.
If the customer is not the organizer at the same time, both are jointly and severally liable.
The customer has no claim to the provision of auxiliary personnel for the transport and setup of goods and other items brought in by the customer or third parties. The delivery of any materials must generally be made via the goods receipt of the Schlosshotel from Monday to Friday between 09:00 and 16:00.
A corresponding notice about the type and scope of the materials to be delivered must be given to the banquet department of the Schlosshotel in advance. For goods or items brought in in advance, the Schlosshotel reserves the right to charge expenses such as personnel, storage, or setup.
Brought decoration material must meet the requirements of the current fire protection regulations, and the Schlosshotel is entitled to request official proof for this. Due to possible damage, the setup and attachment of objects must be agreed upon in advance with the Schlosshotel.
The brought exhibition or other items must be removed immediately after the end of the event. If the customer fails to do so, the Schlosshotel may remove and store them at the customer's expense. If the items remain in the event room, the Schlosshotel may charge room rent for the duration of their stay. The customer remains entitled to prove a lower, the Schlosshotel a higher damage. For materials deliberately left by the customer for disposal at the Schlosshotel, the Schlosshotel is entitled to charge corresponding waste disposal fees.
No liability is assumed for the loss or damage of items brought in unless the damage is due to intentional or grossly negligent behavior of the Schlosshotel or its vicarious agents. Liability limits are defined in the applicable laws.
The customer is liable for the payment of any additional services used by the event participants and for the replacement of losses and damages caused by his employees, auxiliary staff, or event participants.
All services of the Schlosshotel may only be used for the contractually agreed purpose.
Bringing food and drinks requires prior approval.
The currently valid corkage fee is:
- from 45 euros per bottle of white wine (0.75l)
- from 55 euros per bottle of red wine (0.75l)
- from 55 euros per bottle of sparkling wine (0.75l)
- from 85 euros per bottle of champagne (0.75l)
- from 95 euros per bottle of spirits (0.70l).
Newspaper advertisements generally require prior written approval from the Schlosshotel.
If a publication is made without consent and significant interests of the Schlosshotel are impaired as a result, the Schlosshotel has the right to cancel the event. The customer must bear the resulting costs and possible claims for damages.
The customer undertakes to use the ordered services and to pay for them no later than 8 days after receiving the invoice, including any additional services of the Schlosshotel that may be incurred.
This also applies to services and expenses of the Schlosshotel in connection with the event to third parties. Payment must be made to the account at the

In the case of invoice corrections at the request of the customer, which are not due to a misbooking by the Schlosshotel, the Schlosshotel reserves the right to charge a processing fee of 25 euros. The original invoice must be returned to the Schlosshotel in any case.
Additions, changes, and cancellation of the contract require the written form to be effective.
Oral agreements are void. The invalidity of individual provisions does not affect the validity of the remaining provisions.
6. Withdrawal by the Schlosshotel
If it has been agreed that the customer can withdraw from the contract free of charge within a certain period, the Schlosshotel is also entitled to withdraw from the contract within this period if inquiries from other customers for the contractually booked event rooms are available and the customer does not waive his right to withdraw upon request by the hotel with a reasonable deadline.
This applies accordingly in the case of granting an option if other inquiries are available and the customer is not willing to make a firm booking upon request by the Schlosshotel with a reasonable deadline.
If a deposit or security agreed upon or requested according to point 4 is not made even after a reasonable grace period set by the Schlosshotel has expired, the Schlosshotel is also entitled to withdraw from the contract.
Furthermore, the Schlosshotel is entitled to withdraw from the contract for objectively justified reasons, especially if:
- Force majeure or other circumstances for which the Schlosshotel is not responsible make the fulfillment of the contract impossible;
- Events or rooms are booked culpably under misleading or false information or concealment of essential facts; essential can be the identity of the customer, the creditworthiness, or the purpose of the stay;
- The Schlosshotel has justified reasons to believe that the event may endanger the smooth business operation, the safety, or the reputation of the Schlosshotel in public, without this being attributable to the control or organizational area of the Schlosshotel;
- The purpose or occasion of the event is illegal.
The justified withdrawal of the Schlosshotel does not give the customer any claim for damages.
If a claim for damages by the hotel against the customer exists in the event of withdrawal according to the above points, the Schlosshotel can standardize this.
7. Final Provisions
- Changes or additions to the contract, including this written form clause, must be made in writing.
- We point out that animals are not allowed in the Schlosshotel.
- The place of performance and payment is the seat of the Schlosshotel.
- The exclusive place of jurisdiction - also for check and bill of exchange disputes - is the seat of the Schlosshotel in commercial transactions. If the customer does not have a general place of jurisdiction domestically, the place of jurisdiction is also the seat of the Schlosshotel.
- The contract is subject to the law of the Federal Republic of Germany.
- Should individual provisions of these General Terms and Conditions be ineffective or void, the validity of the remaining provisions shall not be affected. The same applies to contractual gaps.
Otherwise, the statutory provisions apply.
